1. Agreement to Terms

These Terms of Use (“Terms”) govern your access to and use of Lovi’s mobile application, website, and related services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least the age of majority in your jurisdiction (or have verifiable parental consent where required by law) to use the Service. You represent that you have the legal capacity to enter into these Terms.

3. Medical Disclaimer

Lovi provides skincare insights and wellness information based on visual analysis. The Service is not a medical device and does not provide medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional regarding any medical concerns. Never disregard professional advice because of information provided by the Service.

4. License & Acceptable Use

Subject to your compliance with these Terms, Lovi grants you a limited, revocable, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes. You agree not to:

• Copy, modify, distribute, or create derivative works of the Service;
• Reverse engineer or attempt to extract source code from any software;
• Use the Service for unlawful, harmful, or infringing purposes;
• Upload or transmit harmful, abusive, or illegal content;
• Interfere with or disrupt the Service or its security;
• Use automated scripts, bots, or scrapers to access the Service;
• Use the Service for biometric identification or facial recognition unrelated to its intended skincare analysis purpose.

5. Accounts & Security

You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms or pose security risks.

6. User Content & Feedback

You retain ownership of any content you upload (such as face images or messages). You grant Lovi a worldwide, royalty-free license to host, process, and display that content solely to operate and improve the Service. You represent that you have all necessary rights to such content.

Feedback or suggestions you submit may be used by Lovi without obligation or compensation to you.

7. Subscriptions & Purchases

• Purchases and subscriptions are billed via the Apple App Store using your Apple ID. Billing, renewal, and refunds follow Apple’s policies. Manage subscriptions in your device settings under Apple ID › Subscriptions.
• Subscriptions renew automatically unless cancelled at least 24 hours before the current period ends.
• Free trials or promotional periods may convert automatically to paid subscriptions unless cancelled in time.
• We may update pricing or features with reasonable prior notice as required by platform policies.

8. Privacy

Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and protect your information, including face-scan data. By using the Service, you consent to these practices.

9. Intellectual Property

All software, design, text, graphics, logos, and other materials forming part of the Service are owned or licensed by Lovi and protected by intellectual-property laws. Except for the limited license above, no rights are transferred to you.

10. Third-Party Services

The Service may link to or integrate third-party services such as analytics, email, or cloud processing. We are not responsible for their content or practices. Your use of such third-party services is at your own risk and subject to their terms.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW,Lovi MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE OR THAT RESULTS WILL BE RELIABLE OR MEET YOUR EXPECTATIONS.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, Lovi AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID (IF ANY) FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to defend, indemnify, and hold harmless Lovi and its affiliates from any claims, damages, liabilities, losses, or expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your content, or your violation of these Terms or applicable law.

14. Suspension & Termination

We may suspend or terminate your access at any time, with or without notice, for behavior that violates these Terms, harms other users, or interferes with the Service. Upon termination, your right to use the Service ceases immediately.

15. Changes to Terms

We may modify these Terms periodically. When changes occur, we will post the revised Terms with an updated “Last updated” date and may provide additional notice if significant. Your continued use of the Service after changes take effect constitutes acceptance of the new Terms.

16. Miscellaneous

• Severability: If any part of these Terms is found invalid, the remainder remains in force.
• No Waiver: Our failure to enforce any right is not a waiver of that right.
• Assignment: You may not assign these Terms without our written consent. We may assign them as part of a merger or sale.
• Force Majeure: We are not liable for delays or failures caused by events beyond our reasonable control.
• Electronic Communications: You consent to receive notices and agreements electronically.
• App Store Terms: If downloaded via the Apple App Store, you acknowledge Apple’s terms apply and Apple is a third-party beneficiary regarding usage rules.
